Welcome to Speakly. These Terms and Conditions of Use ("Terms") govern the access and use of the Speakly web platform and related services. By registering, accessing, or using our services, you agree to be legally bound by these Terms.
1. Definitions
Speakly or we: Refers to Speakly, the online education platform that offers language classes.
Platform: The web application, interfaces, and technological services provided by Speakly.
User or you: Any person who accesses or uses the Platform.
Account Owner: The adult user who creates and administers a Speakly account, including payment and sub-profile management.
Sub-profile: An additional profile created within a main account, intended for a student (who may be a minor or adult).
Student: The person who receives language classes through a profile or sub-profile.
Teacher: The language instructor who provides educational services through Speakly.
Class: A 30-minute language teaching session conducted online through ClassIn.
Package: A set of classes purchased by the Account Owner, available in blocks of 10, 20, 30, 40, 50, or 60 classes per language.
ClassIn: The third-party platform used for live class transmission.
2. Acceptance of Terms
2.1. By creating an account, making a payment, or using any Speakly service, you confirm that:
- You have read, understood, and accept these Terms
- You are at least 18 years old or the legal age of majority in your jurisdiction
- You have legal capacity to enter into a binding contract
- All information provided is truthful, accurate, and complete
2.2. If you create sub-profiles for minors, you declare that you are their father, mother, legal guardian, or have express parental authorization, and you assume full responsibility for the use of the Platform by said minors.
3. User Account and Registration
3.1. Account Creation
To use Speakly, you must create an account by providing:
- Full name
- Valid email or phone number
- Secure password (minimum 8 characters, at least 1 uppercase and 1 number)
- Country of residence
- Time zone
3.2. Identity Verification
All accounts require verification via OTP code (one-time password) sent by email or SMS. You are responsible for maintaining the confidentiality of your access credentials.
3.3. Multi-Profile System
Each account can create up to 3 student sub-profiles. The Account Owner is solely responsible for:
- Management and supervision of all sub-profiles
- All payments and transactions made on the account
- The behavior and use of the Platform by all sub-profiles
- The veracity of sub-profile information
3.4. Parental Control
Speakly offers an optional parental control PIN system to protect the account. It is the Owner's responsibility to activate and manage this functionality.
3.5. Account Security
You agree to:
- Not share your credentials with third parties
- Immediately notify Speakly of any unauthorized access
- Be responsible for all activities performed under your account
- Keep your contact information up to date
4. Services Offered
4.1. Service Description
Speakly offers online language classes in the following languages:
Each class has a duration of 30 minutes and is taught through the ClassIn platform.
4.2. Free Classes
Welcome Class: Each new account receives 1 free welcome class, valid for 15 days from account creation.
Bonus Classes: Depending on the purchased package, 1-2 bonus classes may be granted linked to the purchased package language.
Free classes not used within their validity period will automatically expire and will not be refundable.
4.3. Technical Requirements
To use Speakly services, you must:
- Have a stable Internet connection
- Have the ClassIn application installed (available for iOS, Android, and desktop)
- Have a device with functional camera and microphone
- Meet ClassIn's minimum technical requirements
Speakly is not responsible for technical problems related to the user's device, Internet connection, or the ClassIn platform.
5. Packages, Payments, and Billing
5.1. Package Structure
Classes are sold in packages per language:
- 10 classes
- 20 classes
- 30 classes
- 40 classes
- 50 classes
- 60 classes
5.2. Prices and Discounts
Prices vary according to:
- The selected language
- The user's region (China, Europe, North America)
- The package size (progressive discounts of 10-30% by volume)
5.3. Payment Methods
We use the Airwallex payment gateway to process payments through:
- Debit/credit cards (Visa, Mastercard, American Express)
- WeChat Pay (for users in China)
- Alipay (for users in China)
- PayPal
- Other methods enabled by our Airwallex payment gateway
Transactions are processed in the currency corresponding to your region:
- CNY (Chinese Yuan) for China
- EUR (Euro) for Europe
- USD (US Dollars) for North America and other regions
5.4. Coupons and Promotions
Speakly may offer promotional discount coupons. Coupons:
- Have specific expiration dates
- Are not transferable or redeemable for cash
- Are subject to specific terms and conditions
- May be limited to certain users, packages, or languages
- Are not cumulative unless otherwise indicated
5.5. Payment Processing
By making a payment, you authorize Speakly to:
- Charge the total amount shown to your payment method
- Process the transaction through Airwallex, our payment service provider
You will receive an electronic receipt for each completed transaction.
5.6. Balance Display
Your available class balance is displayed in real time in your account, differentiated by:
It is your responsibility to regularly check your balance.
5.7. Package Validity
Purchased class packages have a specific validity from the purchase date, according to package size:
- 10 classes: 2-month validity
- 20 classes: 4-month validity
- 30 classes: 6-month validity
- 40 classes: 8-month validity
- 50 classes: 10-month validity
- 60 classes: 12-month validity
Classes not used within their corresponding validity period will automatically expire without right to refund. We recommend scheduling your classes in advance to make the most of your package.
Expiration Notifications: You will receive automatic reminders when your package is about to expire, allowing you to renew or schedule remaining classes in time.
5.8. Transaction History
You can access your complete transaction history and download receipts from your account at any time.
6. Scheduling, Cancellation, and Rescheduling of Classes
6.1. Class Scheduling
You can schedule classes up to 30 days in advance according to teacher availability. Classes are scheduled in 30-minute slots.
When scheduling a class, 1 class is deducted from your balance of the corresponding language.
6.2. Consolidated Calendar
The Account Owner has access to a consolidated calendar that displays all scheduled classes from all sub-profiles, with filters to facilitate management.
6.3. Cancellation Policy
You can cancel any scheduled class up to 30 minutes before its start without penalty:
Cancellation without penalty (more than 30 minutes before):
- Access your class calendar
- Select the class you wish to cancel
- Confirm cancellation
- The class will be automatically replaced to your balance
- You will receive email confirmation and in-app notification
Late cancellation or absence (less than 30 minutes before or No-Show):
- If you cancel with less than 30 minutes notice: The class is definitively deducted from your balance without replacement
- If you do not show up to class without having canceled it: The class is definitively deducted from your balance without replacement
- In both cases: No refund or replacement will be made
Reason for this policy:
A late cancellation (less than 30 minutes before) prevents:
- The teacher from being able to reorganize their schedule
- Other students from having been able to schedule and attend that time
- Therefore, the class is considered consumed even though it was not held
System functionality:
- The cancellation button will be visible and enabled until 30 minutes before class
- Once less than 30 minutes remain until start, the button will automatically disable
6.4. Multiple Absences or Late Cancellations
If you present a pattern of absences without notice or recurrent late cancellations:
- Speakly reserves the right to temporarily suspend the account for review
- In serious or repeated cases: Definitive cancellation of the account without refund of remaining balance
- This measure protects teachers and other students in the Speakly community
What is considered inappropriate behavior:
- 5 or more absences (No-Shows) in a 30-day period
- Systematic cancellations with less than 30 minutes notice
6.5. Cancellation by Teacher
If a teacher must cancel a class for justified reasons:
- You will be notified with as much advance notice as possible
- The class will be automatically replaced to your balance
- In cases of recurrent cancellations by the same teacher, Speakly will evaluate additional compensations at its discretion
7. Academic Reports and Evaluation
7.1. Initial Placement Test (IPT)
The Initial Assessment Report (IPT) is available only to users who have purchased a class package.
After taking your welcome class and having completed the purchase of a package, our goal is to deliver this report within 48 business hours. The report includes:
- Initial proficiency level
- Skills assessment
- Personalized pedagogical recommendations
Note: The IPT is not available for users who have only used the free welcome class without purchasing a package.
7.2. Progress Reports
Every 20 class hours (approximately 40 30-minute classes), the student will receive a Progress Report that includes:
- Skills evolution
- Achievements reached
- Areas for improvement
- Recommendations to continue learning
7.3. Post-Class Feedback
Our goal is for the teacher to provide brief feedback within 24 hours after each class, which includes:
- Comments on class performance
- Suggested activity or task
This feedback is visible on the student's dashboard and is automatically archived every 20 classes.
7.4. Intellectual Property of Reports
Reports and evaluations are property of Speakly, but are granted to the student for personal and educational use. They cannot be reproduced, distributed, or commercialized without authorization.
8. User Conduct and Community Standards
8.1. Expected Behavior
All users (Owners, Students, and Teachers) must:
- Treat others with respect, courtesy, and professionalism
- Attend scheduled classes punctually
- Participate actively in educational sessions
- Communicate appropriately and constructively
- Comply with cancellation and scheduling policies
8.2. Prohibited Conduct
It is strictly prohibited to:
- Use offensive, discriminatory, threatening, or inappropriate language
- Harass, intimidate, or abuse teachers or other users
- Record, capture, or distribute class content without express authorization
- Share account credentials with third parties
- Use the Platform for illegal or fraudulent activities
- Impersonate another person's identity
- Attempt to hack, alter, or compromise Platform security
- Use bots, scripts, or unauthorized automations
- Resell, transfer, or commercialize classes or packages without authorization
The decision on sanctions is at Speakly's sole discretion.
9. Minor Protection
9.1. Parental Responsibility
The Account Owner who creates sub-profiles for minors:
- Guarantees being father, mother, or legal guardian of the minor
- Assumes total responsibility for the use of the Platform by the minor
- Supervises the minor's access and activities on Speakly
- Provides the express consent required by law
9.2. Minor Protection Principles
Speakly is designed in line with internationally recognized minor protection principles, considering:
- United States: Parental consent principles for minors under 13 years old
- European Union: Consent of the parental authority holder for minors according to age defined by each member state
- China: Parental consent for minors under 14 years old
- Other jurisdictions: We apply appropriate protection principles according to applicable local laws
Commitment: Speakly commits to evolving its practices to comply with applicable legal requirements in the jurisdictions where it operates
9.3. Minor Data Collection
For minor sub-profiles, we only collect:
- Name
- Date of birth (to automatically calculate age)
- Avatar/profile picture (optional)
- Academic data related to class progress
We never request additional sensitive data from minors without express parental consent.
- Control changes in account settings
10. Privacy and Data Protection
10.1. Information Collection
Speakly collects and processes:
- Identification data: Name, email, phone, country
- Profile data: Avatar, language preferences, time zone
- Payment data: Information processed by Airwallex (we do not store complete card data)
- Academic data: Class history, evaluations, reports, feedback
- Usage data: Platform interactions, notification preferences
10.2. Information Use
We use your data to:
- Provide and improve our educational services
- Process payments and transactions
- Communicate with you (confirmations, reminders, support)
- Personalize your learning experience
- Generate academic reports
- Comply with legal obligations
- Prevent fraud and ensure security
10.3. Information Sharing
We may share limited information with:
- ClassIn: To facilitate live classes (profile synchronization)
- Airwallex: To process payments securely
- Teachers: Only information necessary to teach classes and generate reports
- Authorities: When legally required
We never sell your personal data to third parties.
10.4. Data Security
We implement technical and organizational security measures to protect your information:
- Encryption of sensitive data
- Role-based restricted access
- Continuous security monitoring
- Compliance with international data protection standards
10.5. Your Rights
According to applicable legislation, you have the right to:
- Access your personal data
- Request correction of inaccurate data
- Request data deletion (with limitations according to legal obligations)
- Object to data processing in certain cases
- Request data portability
- Withdraw consent when applicable

10.6. Data Retention
We maintain your data while:
- Your account is active
- It is necessary to comply with legal, tax, or regulatory obligations
- It is necessary to resolve disputes or enforce our agreements
After account deletion, some data may be retained in anonymized form for statistical purposes.
We implement appropriate security measures to protect your data during these transfers, in line with internationally recognized data protection practices.
11. Integration with ClassIn
11.1. Third-Party Service
Live classes are conducted through ClassIn, a third-party platform. By using Speakly, you agree to:
- Install and use the ClassIn application
- Comply with ClassIn's terms and conditions
- That ClassIn has its own privacy and use policies
11.2. Profile Synchronization
Speakly automatically synchronizes your profile information with ClassIn to facilitate class access. This synchronization includes:
- User name
- Unique student identifier
- Scheduled class times
11.3. Technical Limitations
Speakly does not control ClassIn's technical infrastructure. Therefore:
- We do not guarantee continuous ClassIn availability
- We are not responsible for ClassIn technical failures
- Classes require ClassIn to function correctly
- We recommend testing ClassIn before your first class
11.4. User Requirements
It is your responsibility to:
- Download and install ClassIn before your first class
- Verify that your device meets ClassIn requirements
- Have camera and microphone permissions configured
- Keep ClassIn updated
12. Notifications and Communications
12.1. Notification Channels
Speakly communicates with you through:
- Email (primary and mandatory channel)
- In-app notifications
- SMS (optional, according to preferences)
- WeChat (for users in China, optional)
12.2. Types of Notifications
Critical notifications (NOT deactivatable):
- Account security alerts
- Scheduled class reminders
- Payment and transaction confirmations
Optional notifications (configurable):
- Promotions and special offers
- Reminders of unused classes nearing expiration
- Academic report updates
- Speakly news and updates
12.3. Preference Management
You can manage your notification preferences from your account settings, selecting:
- What types of events you want to receive
- Through which channels you want to be notified
Email as base channel cannot be completely deactivated to ensure critical communications.
In-app notifications are automatically cleared each month to keep your inbox organized.
13. Intellectual Property
13.1. Speakly Property
All Platform contents are property of Speakly or its licensors, including:
- Interface design and user experience
- Logos, trademarks, and visual elements
- Proprietary teaching materials
- Pedagogical methodologies
- System algorithms and functionalities
- Reports and evaluation templates
- Business model
13.2. Limited Use License
Speakly grants you a limited, non-exclusive, non-transferable, and revocable license to:
- Access and use the Platform for personal educational purposes
- Download class materials for personal use
- Access your academic reports
This license does not grant you the right to:
- Copy, modify, or distribute Speakly contents
- Use contents for commercial purposes
- Perform reverse engineering of the Platform
- Create derivative works without authorization
13.3. User-Generated Content
By uploading content to the Platform (profile photos, comments, etc.), you:
- Guarantee having rights to that content
- Grant Speakly a license to use that content in the context of providing the service
- Maintain ownership of your original content

14. Limitation of Liability
14.1. Services "As Is"
Speakly provides its services "as is" and "as available". We do not guarantee:
- Uninterrupted or error-free operation
- Specific learning results (progress depends on individual effort)
- Compatibility with all devices and browsers
- Continuous availability of specific teachers
14.2. Liability Exclusions
To the maximum extent permitted by law, Speakly will not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of data, revenue, opportunities, or profits
- Technical problems caused by third parties (ClassIn, Internet providers, etc.)
- Device, browser, or user connection failures
- Inappropriate conduct by other users
- Decisions made based on Platform content
14.3. User Responsibility
You are responsible for:
- Your device, Internet connection, and technical setup
- The content you share on the Platform
- Account use by sub-profiles under your responsibility
- Consequences of sharing your credentials
- Content you post or share
15. Modifications to Terms
15.1. Right to Modify
Speakly reserves the right to modify these Terms at any time. Changes will take effect:
- Immediately for new users
- After 30 days of notification for existing users
15.2. Notification of Changes
You will be notified about material changes through:
- Email to the registered address
- Prominent notification on the Platform
- Update of the "Last updated" date in this document
15.3. Acceptance of Changes
By continuing to use the Platform after the changes take effect, you accept the modified Terms. If you do not agree, you must stop using Speakly and may request account cancellation.
16. Account Termination
16.1. Termination by User
You can cancel your account at any time from settings or by contacting support. Upon cancellation:
- You will lose access to all classes and pending balance
- No refunds will be made for unused classes
- Your data will be handled according to our Privacy Policy
- Some data may be retained for legal obligations
16.2. Termination by Speakly
Speakly may suspend or cancel your account if:
- You violate these Terms
- You perform fraudulent activities
- You present repeated inappropriate conduct
- You fail to comply with payments (in case of future subscription plans)
- For security or legal reasons
In case of justified termination, no refunds will be made.
16.3. Effects of Termination
Upon account termination:
- All use licenses cease immediately
- You lose access to pending classes, reports, and materials
- Pending payment obligations remain in effect
- Sections of these Terms that by their nature must survive (limitation of liability, intellectual property, etc.) remain in effect
17. General Provisions
17.1. Entire Agreement
These Terms, together with the Privacy Policy and any other referenced legal document, constitute the complete agreement between you and Speakly.
17.2. Severability
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.
17.3. Waiver
Speakly's failure to exercise any right under these Terms does not constitute a waiver of that right.
17.4. Assignment
You may not assign or transfer your rights or obligations under these Terms without Speakly's prior consent. Speakly may assign these Terms to any successor or affiliate.
17.5. Notices
All legal notices must be sent in writing to: info@speakly.fun
Notices to users are considered delivered when sent to the email registered in the account.
17.6. Force Majeure
Speakly will not be liable for breaches caused by circumstances beyond its reasonable control, including natural disasters, wars, pandemics, Internet failures, government actions, etc.
17.7. Survival
Provisions that by their nature must survive termination (intellectual property, limitation of liability, dispute resolution, etc.) will remain in effect after agreement termination.

Final Acceptance
By checking the box "I accept the Terms and Conditions of Use" during registration, or by using the Platform, you acknowledge that:
- You have read these Terms in their entirety
- You understand and accept all provisions
- You have legal capacity to enter into this agreement
- If you create sub-profiles for minors, you have legal authorization to do so
- You agree to receive communications from Speakly
